Scientists want to do research on your tissues without asking you first
And the Feds want to stop them

Right now, tissues belonging to millions of Americans are being used in scientific research without patients' consent. That's because a rule designed long before genetic analysis was able to reidentify samples makes it legal to do so. If that makes you uncomfortable, then you have until tomorrow night to let the US government know.
Currently, scientists are allowed to use leftover tissues from blood tests, surgeries, and biopsies for research without patients' permission if the patient’s identity is removed. But now that genetic testing has made it possible to link tissues back to their donors, the US government wants to change that. That's why federal regulators have proposed a number of revisions to the Federal Policy for Protection of Human Subjects — a policy that regulates research on humans as well as on their tissues and genes. Among these changes is a proposal that would require that scientists obtain consent for research on biospecimens, regardless of whether the tissues are anonymous or not.
Requiring informed consent could limit "the diversity of patient populations."
The proposed changes are controversial. Involving donors in research might help scientists get better information about the tissues they're working on. Requiring consent might also give donors more control over the ways their tissues are used. Finally, a new consent rule might prevent nasty surprises for donors should their tissues ever be reidentified using genetic analysis. "All research should be done in total transparency, with informed consent, and a reasonable measure of control given to participants," Lauren Wendelken, who identified herself as a former clinical biomedical researcher, wrote in the comments tied to the proposal. But some researchers say that the new rule would lead to a burdensome increase in the amount of work involved in obtaining tissues. Scientists also worry that they won’t get as many tissues if donors have the option of saying no.

"Requiring informed consent would add considerable time and expense to anticipated studies, potentially limiting the diversity of patient populations and the types of pathogens observed," the Infectious Diseases Society of America, the HIV Medicine Association, and the Pediatric Infectious Diseases Society wrote in a comment. "This change from current requirements would have a chilling effect on many types of research that rely on the use of stored biospecimens."
Scientists’ concerns that patients might not want to participate may be unfounded. "People have told me by the thousands, and numerous public opinion studies find the same: they want to know if their biospecimens are used in research, and they want to be asked first," Rebecca Skloot, author of The Immortal Life of Henrietta Lacks, wrote in a New York Times opinion piece last month. Most will probably say "yes" because people understand the importance of scientific research, she says. "They just don’t want to find out later."

The new rule would only apply to new samples, which means the millions of anonymous biospecimens currently housed in US labs would still be fair game. Still, a change like that could affect scientific research for decades to come. Without biospecimens, numerous advances in diseases such as cancer and diabetes would not have been possible. But the original rules were written before concerns over genetic privacy became mainstream.
The government has posted a summary of the proposal, as well as a series of videos that explain the changes. The changes are open for public comment until tomorrow, January 6th, at 11:59PM.

Feb. 29, 2020 at 1:30 p.m. ESTLAIXI, China — The workers in standard-issue blue jackets stitch and glue and press together about 8 million pairs of Nikes each year at Qingdao Taekwang Shoes Co., a Nike supplier for more than 30 years and one of the American brand's largest factories.
They churn out pair after pair of Shox, with their springy shock absorbers in the heels, and the signature Air Max, plus seven other lines of sports shoes.
But hundreds of these workers did not choose to be here: They are ethnic Uighurs from China’s western Xinjiang region, sent here by local authorities in groups of 50 to toil far from home.
After intense international criticism of the Communist Party’s campaign to forcibly assimilate the mostly Muslim Uighur minority by detaining more than a million people in reeducation camps, party officials said last year that most have “graduated” and been released.
But there is new evidence to show that the Chinese authorities are moving Uighurs into government-directed labor around the country as part of the central government’s “Xinjiang Aid” initiative. For the party, this would help meet its poverty-alleviation goals but also allow it to further control the Uighur population and break familial bonds.

(Anna Fifield/The Washington Post)“We can walk around, but we can’t go back [to Xinjiang] on our own,” said one Uighur woman in broken Mandarin as she browsed the street stalls at the factory gate on a recent afternoon. Nervous about being seen talking to a reporter, she quickly scurried away.
When their shifts end, the Uighur workers — almost all women in their 20s or younger — use hand gestures and rudimentary Mandarin to buy dried fruit, socks and sanitary pads at the stalls. Then they walk around the corner, past the factory’s police station — adorned with Uighur writing telling them to “stay loyal to the party” and “have clear-cut discipline” — to dormitories where they live under constant supervision.
The Uighur workers are afraid or unable to interact with anyone in this town, north of Qingdao, beyond the most superficial of transactions at the stalls or in local stores, vendors say. But the catalyst for their arrival here is well understood.
“Everyone knows they didn’t come here of their own free will. They were brought here,” said one fruit-seller as she set up her stall. “The Uighurs had to come because they didn’t have an option. The government sent them here,” another vendor told The Washington Post.
The Post did not ask for their names, out of concern for their safety and so they could discuss an issue that is highly sensitive in China. (While visiting Laixi, this Post reporter was surrounded by seven police officers, questioned, and ordered to leave town.)
The Taekwang factory is one of many where Uighurs are working “under conditions that strongly suggest forced labor” to make goods for more than 80 established global brands, according to a forthcoming report from the Australian Strategic Policy Institute, a Canberra-based think tank.
“The Chinese government is now exporting the punitive culture and ethos of Xinjiang’s ‘reeducation camps’ to factories across China,” said Vicky Xiuzhong Xu, the study’s lead author. In some cases, they found evidence that Uighurs were transferred directly from internment camps to factories.
“For the Chinese state, the goal is to ‘sinicize’ the Uighurs; for local governments, private brokers and factories, they get a sum of money per head in these labor transfers,” Xu said.
Asked about Uighur workers in the factory, Nike said that “we respect human rights in our extended value chain, and always strive to conduct business ethically and responsibly.”
“We are committed to upholding international labor standards globally,” said Nike spokeswoman Sandra Carreon-John, adding that its suppliers are “strictly prohibited from using any type of prison, forced, bonded or indentured labor.”
Kim Jae-min, chief executive of Taekwang, the factory’s South Korean parent company, said about 600 Uighurs were among 7,100 workers at the plant. Nike’s manufacturing map shows that the factory has 4,095 employees, of whom 3,445 are “line workers.”
“The purpose of bringing in migrant Xinjiang workers (in addition to other migrant Han Chinese workers) is to offset the local labor shortage, due to increasing number of competing industries for workers in our area,” Kim said in a statement.

'Listen to the party's words'The ASPI report conservatively estimates that more than 80,000 Uighurs were transferred from Xinjiang to work in factories across China between 2017 and 2019. This figure is consistent with reporting from China’s state broadcaster, which said in November that the Xinjiang government wanted to transfer out 100,000 “surplus laborers” between 2018 and 2020.
Sending young Uighurs away to work can change their mind-set by “distancing them from religiously extreme views and educating them,” said one local government report.
Xinjiang’s Turkic language-speaking, mostly Muslim Uighurs have much more in common with the cultures of central Asia than with China’s Mandarin-speaking Han majority, and have long chafed at Beijing’s oppressive rule.

By the party’s own count, tens of thousands of Uighurs have been sent to Guangdong and Fujian provinces in the south, and to Zhejiang, Anhui and Shandong in the east.
State media reports have described “poor farmers and herdsmen” sent to enterprises inside and outside Xinjiang, portraying them as grateful. “We will feel the party’s favor, listen to the party’s words and follow the party wherever and whenever we go,” a 20-year-old called Zulinar Idris was quoted as saying.
An industry of middlemen has cropped up to facilitate the dispatch of Uighurs, touting “semi-military-style management” and “government management with police stationed at factories.”
In its report, ASPI said it had found evidence that Uighurs were being exploited and that foreign and Chinese companies were involved, possibly unknowingly, in human rights abuses.

BERLIN (AP) — German Chancellor Angela Merkel on Saturday fired a government official whose congratulating of a state governor elected with a far-right party’s help angered Merkel’s coalition partners.
Christian Hirte, a member of Merkel’s Christian Democratic Union who was the government’s commissioner for the formerly communist east and a deputy economy minister, tweeted that he resigned after Merkel told him he could no longer do the job. Merkel’s spokesman, Steffen Seibert, confirmed his dismissal.
Hirte’s departure is the latest fallout from the shock election Wednesday of pro-business politician Thomas Kemmerich as governor of the eastern state of Thuringia. The far-right Alternative for Germany, or AfD, enabled it by supporting him in a vote in the state legislature — as did the regional branch of Merkel’s CDU, against the wishes of its national leadership.
Kemmerich’s acceptance of AfD’s votes appalled left-leaning parties and many in his own center-right camp. Merkel called his election “inexcusable.” The politician from the small Free Democrats announced the day after he was elected that he planned to step down, though it isn’t yet clear when that will happen or whether the state will hold a new election.
Hirte, a deputy leader of the CDU’s Thuringia branch who sits in the national parliament, had congratulated Kemmerich on his “election as a candidate of the center,” tweeting that it showed the state had voted out its previous left-wing government, and making no mention of AfD’s role.
The center-left Social Democratic Party (SPD), Merkel’s junior partners in her often-tense national governing coalition, said Hirte couldn’t stay in his job.
Politicians said accepting votes from AfD broke a taboo and was unacceptable.
Coalition leaders were meeting Saturday to discuss the Thuringia mess, which has prompted new criticism of the leadership of Merkel’s successor as CDU chairwoman, Annegret Kramp-Karrenbauer.
Merkel has vowed that her party will never work with the anti-Islam, anti-immigrant AfD, on a regional or national level.
Kemmerich, from the liberal Free Democrats (FDP), said Thursday: “We want new elections to remove the stain of the AfD’s support from the office of the premiership.”
Thousands took to the streets in cities across Germany late Wednesday to vent their dismay at the vote outcome, including in Berlin, Frankfurt and Thuringia’s capital Erfurt.
Some carried signs that read “Never again,” while others recalled that it was in Thuringia in 1930 that a Nazi minister was first allowed into government.
The aftershocks of the crisis were being felt in Berlin too, since Thuringian state lawmakers from Merkel’s own CDU lined up with the FDP and far right in voting for Kemmerich over popular incumbent Bodo Ramelow from the far-left Die Linke.
Merkel called Wednesday’s vote “a bad day for democracy” and said the role played by her local allies “broke with the values and convictions of the CDU.”
In states across Germany’s former communist east, the AfD is a major political force and mainstream parties are increasingly scrambling to keep it locked out of the corridors of power.
In Thuringia, the AfD is led by Bjoern Hoecke, one of the party’s most radical figures who has called for a “180-degree turn” in Germany’s atonement for Nazi crimes.
A picture of Hoecke shaking hands with Kemmerich after the election win was splashed across the front pages of several German newspapers.
“The handshake of shame,” screamed best-selling daily Bild, slamming Kemmerich for “letting himself be elected by a neo-Nazi.”
On social media, the picture was quickly twinned with one of Adolf Hitler shaking hands with German president Paul von Hindenburg in 1933, the year Hitler became chancellor.
Since its creation in 2003, the AfD has gone from strength to strength in Germany, capitalizing on anger over Merkel’s 2015 decision to allow in over a million Middle Eastern asylum seekers.
At the last general election, the party scored almost 13 percent nationwide and won its first seats in the German parliament.
The SPD’s leader Norbert Walter-Borjans warned that the world was watching how Germany was dealing with the rise of the far right and the “breach in the dam” in Thuringia.
“What has happened here is a signal that we can’t allow to go unanswered,” he said.
