Question K, which would align Baltimore city elections with the presidential cycle.
The citizens of Baltimore do want to align elections with state elections, not Presidential as primaries are rarely attended for Presidential voting....which is the motive for tying it to Presidential. Think about it. Do you go out for Presidential primaries in a heavily democratic state? Especially if the candidate isn't Obama? The answer is NO and that is why your incumbent voted to tie Baltimore's primary to the Presidential race. Check to see who from the Baltimore area State Assembly votes for this and note that it is McFadden that sponsored it. I list my pols below. It looks like the incumbents are trying to seal their incumbency for life on this one. Thanks for Doc Cheatham for shouting out against this. We do not want to give Mayor Rawlings-Blake one extra year in office. It seems funny that I am only today....the day before the election reading of this issue. The Baltimore Sun did speak to this earlier in the year, but nothing since today, the day before elections.

Next week, Baltimore City voters will decide on Question K, which would align Baltimore city elections with the presidential cycle. Right now, the elections take place in an off year between the federal and most state elections.
The City Council and state legislature have already approved the move, but because this is a change to the city charter, it needs approval from city residents. There is some opposition to the measure, including from the Baltimore Election Group, which believes elections should be moved to the state cycle, not presidential. Here's the language on the ballot:
"Resolution No. 12-03 for the purpose of confirming State Legislation, by providing for the election of the Mayor, the Comptroller, and the President and Members of the City Council in 2016 and in every succeeding fourth year; adjusting the terms of office for those elected in 2011."
Supporters of the measure say that aligning the elections with the presidential cycle would increase turnout—in last year’s city primary, 75,000 people voted--about 12 percent of the city's population, and 23 percent of all registered voters in the city. They also cite cost. Because the city is running an extra election, it costs around $3.7 million, total. (In last year's mayoral general election, it averaged out to about $33 per voter.)
Opponents believe elections should be moved – but to the state cycle, not the presidential. They say moving to the presidential cycle would give those currently in office an extra year, and that there's better turnout, generally, for state primaries than for presidential primaries, which is a major election in Democratic Baltimore.
We spoke with Councilwoman Rikki Spector, who sponsored the original bill in the city council, and with Doc Cheatham, a community activist and election specialist who opposes the measure. Councilwoman Spector told us that if voters don't uphold the law, then it doesn't matter--the state law will still take precedent. We confirmed that with City Solicitor George Nilson and the office of the state attorney general. Maryland Sen. Brian E. Frosh (D-Montgomery) on Thursday announced an exploratory bid for attorney general in 2014, releasing a list of more than 100 supporters, many of them prominent names in the state’s Democratic establishment.
Members of Frosh’s exploratory committee include Rep. Chris Van Hollen; Montgomery County Executive Isiah Leggett; Prince George’s County Executive Rushern Baker; former governors Parris Glendening and Harry Hughes; former Attorney General Stephen Sachs; and more than half of Frosh’s colleagues in the state Senate, including President Thomas V. Mike Miller Jr. (D-Calvert).
In an interview, Frosh said he would take the next several months to make a final decision about whether to run but added that he is “about 95 percent of the way there.”
“Unless something dramatic changes, I expect to run,” said Frosh, who is chairman of the Senate Judicial Proceedings Committee and widely viewed as one of the more cerebral members of the chamber.

Brian Frosh Unilaterally Kills Youth Empowerment Bill // Majority of Colleagues Backed School Board Voting Rights BACKGROUND - Over the last few weeks, Maryland Juice wrote about legislative progress to expand student representation on the Montgomery County Board of Education. For years, students throughout the county have voted on a high school senior or junior (aka the SMOB) to represent them on the school board. For almost as long, students have also fought for their SMOB to have a larger role in the Board of Education deliberations. This year, as Maryland was poised to grant Montgomery County's student rep a full vote on the school board, Senator Brian Frosh intervened to kill the effort.
Several notable youth advocates and education figures have spoken out, including Board of Education Member Chris Barclay, the MoCo Young Democrats, and more. A ruckus even broke out on the floor on Monday as several Montgomery Senators tried to save student representation from Senator Frosh's hatchet-job. Maryland Considering Legislation Related to Mortgage Electronic Registration System (MERS)

In 1993, members of the real estate mortgage industry formed Mortgage Electronic Registration Systems, Inc. (MERS) to facilitate the transfer of mortgage loans. MERS records mortgage ownership and servicing rights in an electronic database, obstensibly eliminating the need to record certain instruments in county courthouses and pay the attendant fees. MERS acts as the nominee and mortgagee for its members’ successors and assigns, thereby remaining a nominal mortgagee of record no matter how many times the loan servicing or the mortgage itself is transferred.
Maryland’s legislature is now considering companion bills that clarify that MERS is simply a database, not a nominal mortgagee. The impetus for the passage of these bills, Senate Bill 206 and House Bill 691, arise from issues and disputes accompanying the recent wave of residential foreclosures. NOTE THAT THIS IS AFTER ALL THE MORTGAGE FRAUD WAS OVER!!!
Stepping into the legislative void, several courts in other states have already considered whether MERS enjoys the status of a nominal mortgagee in a foreclosure action. The three state Supreme Courts that have earlier addressed the issue, Maine, Kansas and Arkansas, have each ruled that MERS does not qualify legally as a mortgagee. In the only Maryland decision addressing MERS, the Court of Special Appeals in, Anderson v. Burson, 196 Md. App. 457 (2009), considered the standing of a substitute trustee to pursue a foreclosure on a Deed of Trust transferred via MERS, but the court did not directly examine the standing of MERS as a nominal mortgagee in the chain of title.
The fate of the proposed Maryland legislation and similar efforts in other jurisdictions, including Virginia, may impact the role of MERS in residential loans and the costs associated with transferring and securitizing residential loans. In short, if Maryland ultimately passes this proposed legislation, lending institutions may face additional transaction costs and recordation taxes that have thus far been avoided by virtue of MERS.

ANNAPOLIS, Md., Apr. 14 /CSRwire/ - Maryland Governor Martin O'Malley signed into law the nation's first legislation creating Benefit Corporations, a new class of corporations required to create benefit for society as well as shareholders.
Unlike traditional corporations, Benefit Corporations must by law create a material positive impact on society; consider how decisions affect employees, community and the environment; and publicly report their social and environmental performance using established third-party standards.
The legislation, sponsored by Senators Jamie Raskin and Brian Frosh and Delegate Brian Feldman, passed the Maryland Senate with a vote of 44 - 0 and the Assembly 135 - 5.
Benefit Corp vs. Certified B Corp
Benefit corporations and Certified B Corporations are often, and understandably, confused. Both are sometimes called B Corps by mistake or as shorthand. They share much in common and have a few important differences.
Certified B Corporation is a certification conferred by the nonprofit B Lab. Benefit corporation is a legal status administered by the state. Benefit corporations do NOT need to be certified.
Certified B Corporations have been certified as having met a high standard of overall social and environmental performance, and as a result have access to a portfolio of services and support that benefit corporations do not. THIS IS NOT THE BENEFIT CORP.......BUT IT SOUNDS LIKE IT RIGHT?
What are the commonalities between benefit corporations and Certified B Corporations?
- Accountability: Directors of both are required to consider the effect of decisions not only on shareholders, but also on other stakeholders, such as workers, community, and the environment.
- Transparency: Both are required to publish publically a report assessing their overall social and environmental performance against a third party standard.
- B Lab: B Lab is the nonprofit organization that helped to develop the benefit corporation Model Legislation and works with the community of Certified B Corporations and others to marshal support for its passage. B Lab is also the nonprofit organization that certifies and supports Certified B Corporations.
- Performance: Each Certified B Corporation has achieved a verified minimum score on the B Impact Asessment (80/200). While benefit corporations are required to publish an annual report assessing their overall social and environmental performance against a third party standard, that report is not required to be verified, certified, or audited by a third party standard organization.
- Support: Certified B Corporations have access to a portfolio of services and support from B Lab to help them with marketing, sales, raising money, saving money, learning from and doing business within the community of Certified B Corps.
- Availability: Benefit corporation is a corporate status legally recognized by 7 states as of 12/15/11. Certified B Corporation is a certification available to businesses in all 50 states and around the world. As of 11/15/11 there are 475 Certified B Corps from more than 60 industries.
