PUBLIC MEDIA IGNORES ELECTION LAWS SURROUNDING PARTICIPATING IN ELECTIONS IN WAYS THAT DO NOT DAMAGE A CANDIDATE’S CAMPAIGN

  Cindy Walsh for Governor of Maryland communicated several times with Maryland Public Television about lack of coverage of my campaign and the failure to include me in the televised forum.  I was told that they would select whom they would have on stage.  When I said this was an election violation and was told to send the statutes showing the illegality -----which I did----I was told when I arrived for the forum that I was not invited to participate.  When I signed the attendance sheet and started to the auditorium I was stopped, told I was trespassing, and threatened with jailing if I did not leave.  This is at a Public Media station.  I was given the standard line of polling and viability while some of the candidates in the forum did not even meet what was then a polling requirement lowered to 5%.  The entire process is arbitrary and exists simply to deny access to campaign events.

Public media and any 501c3 organization have a special obligation to meet the standards of participating in elections in a way that does not damage a candidate's campaign.  While a candidate cannot require equal coverage, they can require adequate access to give the candidate exposure and the public have access to all political platforms in a political race.  It is the 501c3 organizations that balance the private money-driven market of campaign advertising and it is critical that these outlets be held to Rule of Law.

If a candidate has no media exposure at the beginning of the primary that candidate will not poll, he/she will not have name recognition on the ballot, and the public will not know what platforms are available once in the election booth.  When a public media outlet denies access to media coverage throughout the primary and then comes to the candidate with offers of coverage just weeks before the primary -----the damage to that candidate's campaign is done.  Research shows that people have made their choices weeks before an election and in Maryland, voters cannot change political parties after June 3, 2014.

It is critical that 501c3s be held to inclusion of all candidates in coverage from the beginning of the primary.  To allow an event to exclude early in the primary with the intent to include later in the primary damages that candidate’s ability to raise campaign funds, endorsements, name recognition, polling, and ability to create the network needed to get out the vote.


This complaint is against all public media in the state of Maryland and not only MPT.  We have non-profit news journals, radio, and online postings through vehicles like You Tube, Facebook, and website postings that all need to follow the election law of inclusion of all candidates in a political race.  When the Maryland League of Women Voters for example posts the questionnaire completed by Cindy Walsh for Governor of Maryland but only releases video of forums and events including 3 democratic candidates having the freedom of open dialog with an audience, the damage is considerable.

Violations of the election law requiring 501c3 organizations to invite all candidates to debates or forums as the only way to eliminate bias or showing opposition to another candidate.

What Does "Participating in a Political Campaign" Mean?
Organizations with 501(c)(3) status cannot participate in political campaigns.

What is a political campaign? In general, the IRS rule refers to campaigns between people who are running for offices in public elections. These can include: candidates running for president of the U.S.; candidates running for governor; candidates running for mayor; and also candidates for lower elected offices such as school board officials, city supervisors, and county trustees.

What is "participating?" Your organization cannot participate in a campaign, directly or indirectly, on behalf of or in opposition to a candidate. If your organization takes a stand in any campaign, supporting or opposing one or another candidate, this violates the prohibition.

The Glover Report The Anthony McCarthy Interview. The WEAA 88.9 FM Host (Mondays-Fridays, 5-7pm) discusses Maryland politics, including the Governor's Race. McCarthy touches on the three major Democratic candidates and the challenges facing each. A seasoned-talk radio host, McCarthy is also one helluva journalist. His honors include being the youngest editor of the Afro American Newspaper. He is featured regularly via Baltimore media and has earned a reputation for one of the hottest news talk show in the USA. Marc Steiner was one of the public media outlets that had staff send a request for time on the show just weeks before the primary after many attempts by my campaign to have access early in the primary.  Appearing on a show at this late stage tells the audience that this is not a serious candidate.  The bias created by exclusion throughout the primary race cannot be erased with one interview spot weeks before an election and everyone understands this.

Keep in mind that Cindy Walsh for Governor of Maryland is a resident of the City of Baltimore with a campaign platform that most residents of the city want to hear.  With a platform that centers on civil rights and liberties and public justice and with a city with a population strongly people of color and low-income-----this is a civil rights violation as well as media in Baltimore City made sure my campaign and platform was nowhere to be found.  The censure in Baltimore was complete and it was willful and deliberate because of my platform.

Maryland Gubernatorial Candidate Del. Heather Mizeur And Running Mate Rev. Delman Coates

May 20, 2014 – Segment 2 – We are joined by one of Maryland’s Democratic Gubernatorial Candidates and her Lieutenant Governor running mate: Delegate Heather Mizeur, who represents District 20 in the Maryland House of Delegates, and is a candidate for Governor of Maryland; and the Rev. Delman Coates, Senior Pastor of Mt. Ennon Baptist Church in Clinton, Maryland, and candidate for Maryland Lieutenant Governor.

WYPR was willful and deliberate in violating election law.  The staff showed complete contempt, not only for my campaign, but for the voter's right to exposure to all platforms.  WYPR repeatedly stated there was no candidate for governor from Baltimore----which I am that candidate----they said at every turn that there were only 3 democratic candidates for governor-----and one staff literally stated after a first poll showed 55% of democratic voters and 70% of republican voters 'undecided' that if voters did not like the candidates being put forward by media then 'do not vote'.

The willful and deliberate exclusion of a candidate for office from the very city in which these public media outlets operate represents the level of capture in the City of Baltimore of elections of all kinds.  These election violations are done openly and with impunity showing contempt for any candidate with a platform counter to what these 'public' media outlets want the public to hear.  WYPR needs to have its license revoked for its behavior.

Vote 2014 Transportation Forum Rebroadcast Dates (Video) by Staff Writer


Purple Line NOW! hosted a Transportation Forum with Maryland’s gubernatorial candidates on February 18 at the Montgomery College Cultural Arts Center on the Takoma Park/Silver Spring campus.

Candidates who declared or filed their intentions by the end of January 2014 were invited to participate in the event. Participants included:  Howard County Executive Ken Ulman running mate of Lt. Governor Anthony Brown, Attorney General Doug Gansler, Charles Lollar and Delegate Heather Mizeur.

Candidates shared their positions on the current transportation situation in Maryland, their vision for the future, and what they, as governor, would do to help that vision become a reality.

Audience members included transit enthusiasts, labor groups, students, elected officials, etc.  Montgomery College Vice President and Provost Dr. Brad Stewart introduced the candidates.

Candidates for Gov. Speak to African Immigrants in Silver Spring (Photos)

Four candidates for Governor addressed more than 2,000 African Immigrants on Sunday (June 8) in Silver Spring.

The African Immigrant Caucus hosted the event at The Redeemed Christian Church of God in an effort for Ethiopians, Nigerians, Liberians, Cameroonians and other African Immigrants to engage with Maryland Gubernatorial Candidates Lt. Governor Anthony Brown, Attorney General Doug Gansler, Del. Heather Mizeur and Rep. Charles Lollar.

“June 8th will go down in history as the day African immigrants in the U.S. finally found their voice and embraced their role as equal partners with their fellow Americans in the ongoing struggle to make America a better place for all,” says AIC leader Bishop Darlingston Johnson, pastor of Bethel World Outreach Church in Silver Spring.

‘The first televised debate in Maryland's Democratic primary for governor will be May 7, followed by a second debate on June 2, according to the stations that will broadcast them.
The first TV debate matching Lt. Gov. Anthony G. Brown, Attorney General Douglas F. Gansler and Del. Heather R. Mizeur is scheduled for 7 p.m. May 7 at the University of Maryland, College Park and will be broadcast on Washington's NBC affiliate. According to NBC4, "Meet the Press" host David Gregory will moderate'.


 

Justin Schall, campaign manager for Brown, confirmed the plan and said the three candidates are still working out details. The Gansler and Mizeur campaigns declined to comment.
Maryland Public Television said Thursday it will host and air the second debate with the three Democratic contenders on June 2, a co-production with WBAL-TV’.

This is Cindy Walsh for Governor of Maryland on the democratic ticket.  The one you did not include in this forum.  As a 501c3/4 organization you are required to extend an invitation to all candidates in a race and to fail to do so is deliberate intent to damage the campaign of others running.  Everyone knows that with a polling of around 10% of democratic voters supporting Gansler and Mizeur we have no 'front-runners' and indeed if my platform was heard the 54% of undecided will have found their candidate----or already have.

 

The public university is the bedrock of political debate and discussion.  If you as President deliberately seek to silence a candidate because of political views you do not support you are failing as head of a public university.   My candidacy is real------I am qualified and more capable than any of the candidates you 'selected' to appear.  You have a responsibility as an education leader to uphold election law and allow all voices to be heard at all times but especially at election primaries and general elections.  I am pursuing the failure of 501c3/4 in Maryland to meet the election law requirement of doing no harm to election campaigns and these events are front and center.

Indeed Lois, I know the intention.  What I ask of any justice organization is that you make yourselves aware of how 501c3/4 organizations are being captured from meeting the organizational missions at a time when the powers that be are dismantling the very social structures these 501c3/4 are charged with protecting.  The issues for voting advocates like yourselves includes the invitation of all candidates to public forums and debates and providing that vehicle for all to learn about the candidate and platform----via videos or media partnerships that are inclusive.  Many organizations follow this but many do not.  LWV should be outing and encouraging those organizations that break this law to stop this practice of selective forums.  This Trans Pacific Trade Pact TPP will end our status as citizen and leave us with no reason to vote.....as has happened in Baltimore where Johns Hopkins literally runs the city.  There is no need to vote unless as in developing worlds the dictator requires that everyone come to the polls and vote for him/her.  We know women will be the most disenfranchised group as women are always pushed to poverty first.

 

My campaign is about winning but as important it is about showing the citizens of Maryland how captured these elections are and how much election rigging occurs by organizations tasked with working in the public interest.  I am compiling these problems for a court case that will contest the election whether I win or lose.

    Hello Karen,  

Somehow Cindy Walsh was not invited by any environmental group in Maryland to speak to membership and I am the only environmental candidate for governor in the race.  Maryland has an abysmal environmental record and environmental policy is simply throwing out single-issue legislation that is almost always never implemented.  No oversight and accountability on all things environment allows for much greening funding to be lost to fraud and corruption and then there is the elephant in the room-----TRANS PACIFIC TRADE PACT ALLOWS GLOBAL CORPORATIONS COMING TO THE US TO IGNORE US LABOR AND JUSTICE LAWS----INCLUDING ENVIRONMENT if it cuts into profit----which is all laws.

 

Please shout this out-----we need environmental groups to educate the citizens on policy that works against the public interest.  Maryland is one those states where the public knows nothing about major issues because private non-profits are silent and not advocating and educating.

This is Cindy Walsh for Governor of Maryland contacting you with a concern.  Your Maryland chapters are failing to invite my campaign to political forum events in the spirit of election law that has 501c3s required to invite all candidates in an election to these events.  I have notified the Prince George's Chapter sponsoring an event on April 28 in Bowie that I will be attending, asking for confirmation of my participation.

 

Sadly, I am the labor and justice candidate that has as its campaign platform strong protections of civil rights and liberties and the protection of public programs that lifted the largest number on underserved from poverty in the 20th century.  So, omitting the voice so relevant to most of the people of color in Prince George's and Baltimore seems counter to what a political forum would represent.  These are violations of election laws and when an organization promotes voter registration and voter turnout but fails to allow an educated voter to go to the polls.....it is a missed opportunity for justice.

 

I will be taking these transgressions to the Federal Election Board and possibly to court as my campaign is about rebuild free and fair elections in Maryland.  I write to you because this is probably happening across the country.  Thank you for listening and please direct your Maryland chapters to include my campaign.

I will end with one more comment......what I see is yet another promotion of only the same three candidates and none of my views making it to the larger public forum.  It doesn't cost too much for a university audio-visual team to record this event.  I am pleased with the inclusion but it is disappointing that an event of governor's forum on transportation has a full videotape of the discussions and an event of this importance finds no video-tape to post.  I had my own people recording this event, but it is disappointing that equal opportunity did not extend beyond the group attending this program.

Campaign success is not judged by money no matter how many times the media tries to make it such.  I have plenty of support for the campaign without media......probably more than the less than 10% of Gansler and Mizeur.  This election will break old alliances because the citizens of Maryland have had enough.  You have no right as public media to define what basis a campaign is designated successful.  That is called bias.  Your job in elections is to present the platforms and allow the public to decide what they want. 

Read the news Len.....people do not want money in politics whether democrat or republican so basing your coverage on a candidates money represents a total disconnect to what elections are about.  If you do not think you are advocating or endorsing when  you write about the same 3 democrats over and again....if you think you are not harming the other candidates races....DO NO HARM SAYS THE LAW....you do not understand what free and fair elections and staying out of politics is about.  You either give time to all or stay out of the election news!

This is Cindy Walsh contacting the WBFF station about a failure to invite my campaign on these primary events.  The idea of having a televised debate that had only two candidates for governor already having months of saturated media attention and both garnering about 10% of democratic voter support while leaving 3 other candidates for governor out of the primary coverage completely is a failure of WBFF to provide what its listeners want----free and fair election coverage.  The idea that politicians are going to be deemed ‘front-runners’ with campaign platforms that no one wants removes credibility of the media station’s commitment to providing election coverage in the public’s interest.

I have listened to WBFF newscasters say first that ‘there are no candidates for governor from Baltimore…..when of course I am the candidate from Baltimore and I have listened to newscasters say they are going to have all democratic candidates on to share their primary platforms but as of today----my campaign receives no response to my requests to the briefest of airtime.  I am sending this message to Baltimore as I am to Sinclair Broadcast Group.

Baltimore has one of the most captured of political systems and it is the media and how it approaches primary coverage that allows for a very crony and corrupt political system to thrive.  I will assume Fox News wants its listeners to believe they support unbiased coverage of elections.

I will see your organization in court as we work to rebuild free and fair elections in Baltimore and Maryland.  As you know, a 501c3/4 organization cannot participate in elections in ways that damage a candidates campaign and leaving a candidate out of a forum does just that.  As I educate citizens in the communities and who attend your churches how you favor giving the spotlight to candidates dedicated to dismantling all that is public including public justice, who are dedicated to ending all War on Poverty and New Deal programs and who will embrace Trans Pacific Trade Pact TPP ending the US Constitutional Bill of Rights and American's status as citizen, who propagate the worst system of fraud and corruption in the nation---Maryland ranked at the bottom nationally----

As I said-----I not only responded once----but twice, the first time on April 24, 2014.  So, you deliberately took a stance that I did not respond as a defense for keeping me from participating in an election forum.  This is illegal as 501c3/4 organizations are not allowed to participate in elections in ways that damage a candidate's campaign.  Would you agree that denying me an opportunity to participate damages my campaign?

It is the Pastors in Baltimore who do the same thing in selecting who will speak at events and what is said-----absolutely killing free and fair elections and rigging elections for the very corporate politicians dismantling public justice, civil rights, and equal protection......harming most the very people Pastors serve.  The citizens of Maryland are finished with rigged elections; we are tired of watching the abuse and injustice that is hitting everyone but people of color the most.  We will have free and fair elections in Maryland as we educate citizens as to how Rule of Law works and who fails to follow Rule of Law.

I will be adding your church and Collective Empowerment Group to a Federal Court lawsuit addressing election violations in Maryland.

This is Cindy Walsh for Governor of Maryland on the democratic ticket.  I have not been informed or invited to the Governor's Forum sponsored by BUILD.  Since I am the only REAL progressive labor and justice candidate for Governor, my platform is what most of your audience will want to hear.

 

501c3s are required to send an invitation to all candidates to these forums as to leave one out would damage that campaign.  It hurts free and fair elections, it violates election laws, and in this case....you are inviting global corporate politicians who are killing democracy and ending public justice while leaving out the one candidate that makes all of this her platform.

What Does "Participating in a Political Campaign" Mean?
Organizations with 501(c)(3) status cannot participate in political campaigns.

What is a political campaign? In general, the IRS rule refers to campaigns between people who are running for offices in public elections. These can include: candidates running for president of the U.S.; candidates running for governor; candidates running for mayor; and also candidates for lower elected offices such as school board officials, city supervisors, and county trustees.

What is "participating?" Your organization cannot participate in a campaign, directly or indirectly, on behalf of or in opposition to a candidate. If your organization takes a stand in any campaign, supporting or opposing one or another candidate, this violates the prohibition.

Your reporting on the Governor's forum in Bowie had Cindy Walsh really marginalized and indeed really did not reflect what I actually said.  You have photos of candidates for Governor but not mine.  Since only 10% of polling shows support of Gansler and Mizeur by democrats dismal and Brown, after months of campaigning receiving barely 25%----republicans just as bad.....maybe this is because the citizens of Maryland are looking for Cindy Walsh for Governor and her platform.  Is this why you keep leaving my campaign out of all media?  It isn't the polling numbers....we are going to rebuild free and fair elections in Baltimore and Maryland.   Come with us!

This is Cindy Walsh for Governor of Maryland.  I read where Anthony Brown came to your establishment to talk to your residents and wanted the same for my campaign.  When a 501c3/4 gives time to one candidate during an election-----it needs to give time to all candidates to meet the requirement of doing no damage to a candidate's campaign.

 

It is good practice to open all political discussion during election season to all candidates in a race so Maryland can return to having free and fair elections.

I have sent a Federal Election Commission complaint on Election violations in Maryland.  I will forward this concerns to Maryland Elections as I meet with them.  The idea that our public university system would fail to meet election law in doing no damage to an election-----would deliberately exclude political discussion and discourse because of the content of a candidate's platform ----political freedom is a bedrock of public universities for goodness sake.  I expect the Maryland Election Commission to respond to my concerns regarding the handling of this democratic primary by 501c3/4 organizations including public universities and public media.

This is Cindy Walsh for Governor of Maryland on the democratic ticket.  I completed the survey and went to the Voter Guide and see nothing about the governor's race.  I do see copious commentary on Brown, Gansler, and Mizeur-----a free ride for these three candidates to the exclusion of 3 other candidates and this on public media where 5013c/4 organizations are not allowed to participate in elections in ways that damage a candidate's campaign.  Everyone knows that all candidates in a race are invited to forums and discussion.  Public media and public universities are the bedrock of democracy at a time when private media is captured and elections skewed by money.  So, you are failing in free and fair elections and the requirement no to damage the campaigns of others when you censure selected candidates.  It is illegal.

 

When a public media outlet comes to me after 3 months of primary campaigning at the last few weeks of the primary to talk about my campaign after saturated coverage for my opponents----you are deliberately placing a burden on my candidacy and damaging this campaign and you know it.

 

The American people are rebuilding public justice and Rule of Law and it starts with elections like this.  That is why Cindy Walsh for Governor of Maryland will be taking this election race to Federal Court for systemic election violations especially within the 501c3/4 organizations.

We are in the last two months of the primary elections for 2014 and Cindy Walsh for Governor of Maryland has been mentioned a few times----never by name and yet I am just 10% away from being tied with the 'front-runners' with several months of media saturation.  Brown 25%, Gansler and Mizeur around 10% with over 54% undecided democratic voters.  Imagine if Cindy Walsh had received a fraction of that media coverage-----there is the platform 54% of democrats seek!  More would come.

Baltimore Sun and its many local news journals have never mentioned Cindy Walsh the candidate for Governor.  WYPR has mentioned her a few times as 'one of two other candidates' but now only act if 3 candidates are in the democratic race.  I searched Maryland Public Television----bastion of free and fair elections in Maryland and not a word.  I am not on the list of Governor's candidates in Baltimore Sun or MPT.  Morgan State and WEAA with Marc Steiner has not mentioned my campaign nor had me on.

Dan Rodricks had a show on the governor's race and all of the callers stated they did not want Brown or Ganser but someone 'like' Mizeur.  That is of course----Cindy Walsh for Governor of Maryland.

No Baltimore news program taped and aired the Montgomery County forums that had the one candidate from Baltimore included in the forum.  Having a candidate from Baltimore running in this governor's race is never mentioned.  I am 10% away from being a 'front-runner'  and 30% from winning the election and you will not hear it in Maryland media.

So, Cindy Walsh for Governor of Maryland has a Federal Election Commission complaint and will pursue this in court.  The citizens of Maryland will rebuild free and fair elections in Maryland!
